The Centre for Environmental Rights submitted an Answering Statement on 4 March 2016 on behalf of groundWork to appeal the authorisation of a 600 MW coal-fired power plant for KiPower (Pty) Ltd near Delmas, Mpumalanga. The submission was four days late, and a request for condonation was included.

• The submission was made in response to a Responding Statement filed by Jones & Wagener (Pty) Ltd, the Environmental Assessment Practitioner for the Second Respondent, on 28 January 2016.
• The Answering Statement was submitted four days after the original deadline of 29 February 2016; consequently, the appellant requested condonation for the late submission under regulation 63(3) of the 2010 EIA Regulations.
