A letter from the South African Department of Environmental Affairs clarifying that Newshelf 1282 (Pty) Ltd must complete climate change and paleontological impact assessments before commencing a proposed 1200MW coal-fired power station project, while maintaining that the initial environmental authorisation was not unlawful.

• The Minister of Environmental Affairs instructed the applicant, Newshelf 1282 (Pty) Ltd, to perform a paleontological impact assessment and a climate change impact assessment within six months of the 7 March 2016 decision. The Department states that this requirement does not mean the original decision to grant environmental authorisation was unlawful.
• The proposed 1200MW coal-fired power station project cannot begin until the required climate change and paleontological impact assessments are completed and submitted to the Department. These assessments must follow the Environmental Impact Assessment Regulations, 2010, including processes for scoping, assessment, and public comment.
