APPEAL AGAINST THE WATER LICENCE (WUL NO. 06/B11F/CGIHE/6684) ISSUED FOR KHANYISA COAL BASELOAD INDEPENDENT PRODUCER PROJECT (KHANYISA PROJECT)

This document is a letter from the Department of Water and Sanitation (DWS) to the Water Tribunal regarding an appeal by the Centre for Environmental Rights (CER) against a water licence issued for the Khanyisa Coal Baseload Independent Producer Project. The DWS provides a detailed response to CER's claims concerning the number of applications submitted and the specific expert reports and documents considered during the assessment process.

• The Department of Water and Sanitation (DWS) clarifies the timeline and nature of the Water Use Licence (WUL) applications for the Acwa Power Khanyisa Thermal Power Station (RF) (Pty) Ltd. An initial application was submitted in November 2016, followed by the submission of an Integrated Water Use Licence Application (IWULA) and Integrated Water and Waste Management Plan (IWWMP) volumes 1 to 3 and engineering designs in February 2017, and subsequently IWULA and IWWMP volumes 1 to 6 in June 2017.
• DWS addresses the use of expert reports across different applications, noting that the geohydrology report from August 2011 was identical for both the November 2016 and June 2017 applications. Additionally, the Draft Framework Environmental Management Programme (October 2011), the EMP for the water pipeline, and the Specialist Surface Water Quality Impact Assessment Report were the same across the February 2017 and June 2017 applications.
• In response to the Centre for Environmental Rights (CER) claim that the record was incomplete, DWS lists the specific supplementary documents considered in the decision to grant the WUL. These include title deeds, a public participation report, environmental authorisations, a water balance, a service agreement for water supply, and a section 27 (1) motivation.
