REGULATION OF UPSTREAM GAS AND PETROLEUM ACTIVITIES: ISSUES ARISING

A response from the Petroleum Agency SA (PASA) to the Centre for Environmental Rights regarding the regulation of upstream gas and petroleum activities, addressing public access to rights, environmental inspectors, and the status of hydraulic fracturing.

• Rights granted under the MPRDA must be registered with the Mineral and Petroleum Titles Registration Office (MPTRO), though public access to these records is not automatic and requires permission from the Director-General of Mineral Resources.
• The Petroleum Agency SA (PASA) states that, according to its records, no hydraulic fracturing has been authorised in relation to granted onshore gas exploration and production rights.
• Regarding Afro Energy, PASA notes the entity holds an exploration right allowing for the drilling of exploration wells, but the agency declined to comment on the lawfulness or authorisation of Afro Energy's 'pilot production project'.
• PASA is currently considering the Draft Guidelines for CCIA issued by the Department of Environment, Forestry and Fisheries.
