CENTRE FOR ENVIRONMENTAL RIGHTS / NATIONAL TREASURY: APPLICATION FOR ACCESS TO INFORMATION IN TERMS OF THE PROMOTION OF ACCESS TO INFORMATION ACT, 2000 - CER-2018-TRE-0001

The Centre for Environmental Rights (CER) sent a letter to the South African National Treasury on 16 November 2018 seeking clarification on a partial response to a Promotion of Access to Information Act (PAIA) request. The request concerned financial guarantees and agreements related to the Thabametsi and Khanyisa coal-fired power station projects under the Coal Baseload Independent Power Producers Procurement Programme (CBIPPP).

• The Centre for Environmental Rights (CER) requested specific documents from the National Treasury regarding the Thabametsi and Khanyisa coal power station projects, including the Government Support Framework Agreement (GSFA), schedules to the GSFA, records of Treasury guarantees, and constitutional reports on government guarantees for 2017 and 2018.
• An April 2017 request for concurrence sought approval from the Minister of Finance for indemnities of R25.2 billion for the coal IPPs, with a maximum exposure of R225.2 billion.
• The CER identified several ambiguities in the National Treasury's partial response, including whether the Minister of Finance ever formally granted concurrence for the coal IPPs after requesting an urgent meeting in July 2017 to discuss financial challenges to Eskom's balance sheet.
• The CER is seeking confirmation on whether Schedule G of the GSFA and the Implementation Agreement for the coal IPPs have been signed and agreed upon by the necessary parties.
