This document consists of a letter from the South African Department of Water and Sanitation to the Centre for Environmental Rights (CER) and a formal petition from ACWA Power Khanyisa Thermal Power Station (RF) (Pty) Ltd. ACWA Power is requesting that the Minister of Water and Sanitation uplift the automatic suspension of its Integrated Water Use Licence (IWUL), which was suspended following an appeal lodged by the CER on behalf of groundWork.

• ACWA Power requests the urgent upliftment of the suspension of its Integrated Water Use Licence (IWUL), reference number 06/B11F/CGIHE/6684, which was issued on 7 December 2017 and suspended after an appeal by the Centre for Environmental Rights (CER) on 8 August 2018.
• ACWA Power argues that the suspension causes significant prejudice, including risks to the signature of the Power Purchase Agreement (PPA) and Implementation Agreement (IA), and prevents site activities such as levelling for piling in the power block area, which trigger section 21(c) and 21(i) water uses.
• The project is designed as a Zero Liquid Effluent Discharge (ZLED) system, meaning no liquid will be discharged on site or into surrounding areas, and it will use reclaimed and treated mine waste water from the eMalahleni Water Reclamation Plant instead of fresh water.
• ACWA Power claims the project supports South Africa's energy security and the draft IRP 2018, specifically by including 1,000MW of 'coal to power' and utilizing a unique circulating fluidized bed combustion technology that uses discard coal.
• ACWA Power characterizes the legal challenges from the CER and groundWork as part of an "orchestrated campaign" called "Life After Coal" intended to prevent any new coal-fired power stations regardless of their specific merits or mitigation measures.
