• The Limpopo Department of Economic Development, Environment & Tourism granted Delta Built Environmental Consultants an extension until 31 January 2021 to submit the Environmental Impact Assessment Report (EIAR) for the proposed metallurgical cluster for the Musina-Makhado SEZ. The department stated that no further extensions would be granted for the public participation process or any part of the EIA process because the project is already significantly beyond the regulated timeframes of the EIA Regulations, 2014.
• The submission requirements for the EIAR include three hard copies and one soft copy. The report must reflect the incorporation of comments from registered Interested and Affected Parties (I&APs) following a Public Participation Process of at least 30 days. The department specified that the period from 15 December 2020 to 05 January 2021 must be excluded from the reckoning of days for prescribed timeframes, and public participation must not occur during public holidays.
• Failure to meet the 31 January 2021 deadline will result in the application being deemed closed, requiring the applicant to lodge a new application under the EIA Regulations of 2014. The department also reminded the recipient that starting a listed activity without Environmental Authorization is prohibited under Section 24F of the National Environmental Management Act, 1998.
