RICHARDS BAY GAS POWER 2 (PTY) LTD – ENVIRONMENTAL AUTHORISATION AMENDMENT

The Centre for Environmental Rights, acting for groundWork, has requested an extension of the time period to institute judicial review proceedings against the Minister of Forestry, Fisheries and the Environment's decision to grant an Environmental Authorisation Amendment for Richards Bay Gas Power (Pty) Ltd.

• The Centre for Environmental Rights, representing the non-profit environmental justice organisation groundWork, is seeking an extension under section 9(1) of the Promotion of Administrative Justice Act 3 of 2000 (PAJA) to file for judicial review of a decision made by Minister Barbara Creecy.
• The request for extension is based on the delayed receipt of the Air and Climate Change Report (ACCR), which was furnished to the client on 09 February 2022. This report was used by the Minister to conclude that climate change impacts of the amendments were adequately considered, despite the report not being part of the record available to interested and affected parties or the decision-maker initially.
• groundWork contends that the decision to grant the amendment was unreasonable because the Minister relied on irrelevant considerations and ignored critical comments that would have been available if the ACCR had been included in the public participation process.
• The appellant proposes to bring the review application within 60 days of the letter dated 18 February 2022, noting that if the extension is refused, they will seek it or condonation from the Court.
