This document is a draft written reply from the Minister of Water and Environmental Affairs to a National Assembly question (No. 575) regarding a coal washing plant's compliance with the National Water Act in the eMalahleni Municipality.

• The Department of Water and Environmental Affairs took enforcement action against a coal washing plant adjacent to Jackaroo Park, issuing a notice of intention to issue a directive on 1 July 2010. A follow-up inspection occurred on 10 August 2010, and the company submitted a representation on 29 September 2010.
• The coal washing plant does not possess a valid water use license as required by section 21 of the National Water Act, 1998. While the company submitted registration forms for waste discharge related water uses to the Water Registration Management System (WARMS) database on 27 August 2009, it has not obtained the necessary license.
• The company has been fined by the Mpumalanga Department of Economic Development, Environment and Tourism and has applied for a section 24(g) under the National Environmental Management Act, 1998. This process includes an application for a water use license.
• Inspections of the operation were conducted on 7 June 2010 and 10 August 2010 by officials including Control Environment Officers and a Chief Auxiliary Services Officer.
