This document is a draft written reply from the Minister of Water and Environmental Affairs to a National Assembly question (No. 1267) posed by Mr G R Morgan (DA) regarding the water use licence awarded to Vele Colliery.

• The Department issued the Vele Colliery Integrated Water Use License on 29 March 2011. The license was issued by the Department's Accounting Officer because it involved sector transfers, specifically the transfer of water allocation from the agriculture sector to the mining sector.
• The water use license authorizes two specific activities: the extraction of 2,452,800 cubic metres per annum (m3/a) from boreholes and the dewatering and reuse of 109,500 m3/a.
• The water authorization did not require additional allocation from the catchment because it utilized existing allocations from the farm purchased by Vele Colliery (Portion 3, 4 and 5 of Overvlakte 125 MS), which had borehole water allocations of 5.1526 Mm3/a and irrigation water allocations from the Limpopo River of 3.3 Mm3/a.
• The Department considered the impact of mining on the Limpopo River, a shared water course with Mozambique, Botswana, and Zimbabwe. An independent review of the mine's impact prediction concluded that the Limpopo Coal Company's proposed action plan and commitments would address shortcomings in the geochemical specialist work. To comply with the South African Development Communities protocol, the mine must immediately notify the Department’s Regional Head: Limpopo of any emergency affecting the Limpopo River or nearby groundwater.
