This document is a draft written reply from the Minister of Water and Environmental Affairs to a National Assembly question (Question 252) asked by Mrs S V Kalyan (DA) regarding a waste oil refinery in Cato Ridge, KwaZulu-Natal.

• The waste oil refinery in Cato Ridge does not possess a water use license because its activities are not covered by the National Water Act, 1998, although it is required to hold a waste license under the National Environmental Management: Waste Act, 2008.
• The Department was notified on 11 January 2011 that the company was discharging oil-contaminated water. An investigation on 17 January 2011 determined the discharge was a spillage occurring during operations, which the company subsequently cleaned up. Follow-up inspections on 28 January 2011 and 10 February 2011 found no further spillages.
• The eThekwini Municipality, acting as the relevant authority under section 30 of the National Environmental Management Act, 1998, issued a notice and informed the Department that the company would be fined according to municipal by-laws.
• The Department did not issue directives to the company because the spillage had been cleaned before the inspection. As of the date of the reply, the Department of Environmental Affairs was reviewing information from the 10 February 2011 investigation.
