This document is a draft written reply from the Minister of Water and Environmental Affairs to a National Assembly question (No. 1058) posed by Mrs. S V Kalyan (DA) regarding the Rooiwal sewage treatment works and the Tshwane Metropolitan Municipality's compliance with the National Water Act.

• The Department of Water Affairs issued a notice of intention to issue a directive on 19 January 2011 and a formal directive on 8 March 2011 under section 19 of the National Water Act, 1998, to compel the Tshwane Metropolitan Municipality to take corrective measures at the Rooiwal sewage treatment works.
• No criminal charges have been filed against the Tshwane Metropolitan Municipality because the municipality provided an action plan and requested an extension of time from the Water Tribunal to follow procurement processes required by the Municipal Financial Management Act, 2003.
• The Rooiwal sewage treatment plant is operating above its design capacity of 220 megalitres per day (ML/d), and its current effluent discharge fails to meet required discharge standards, resulting in foaming in the river downstream.
• To rehabilitate the plant, the Tshwane Metropolitan Municipality submitted an action plan to the Department on 16 March 2011, which includes the process of appointing consulting engineers for the extension of the Rooiwal Wastewater Treatment Works.
