This document is a draft reply from the Minister of Water and Environmental Affairs to a written question from the National Council of Provinces regarding sewage spillage into the Mooikloof dam and the role of the Kungwini Local Municipality.

• An investigation conducted by the Department of Water and Environmental Affairs on 11 March 2011 confirmed that raw sewage was overflowing from a local pump station in the Mooikloof area.
• The sewage overflow was linked to a dispute between the Kungwini Local Municipality and the developer of the Mooikloofridge Estate over the ownership and maintenance of the pump station. No signed agreement exists because the Municipality is awaiting the developer to address specification issues related to the pump station.
• The Mooikloofridge Estate has corrected the sewage situation while the Department facilitates a process to clarify the roles and responsibilities of the Municipality and the Developer.
