This document is a draft written reply from the South African Minister of Water and Environmental Affairs to a question posed by Mr O de Beer (COPE-WC) in the National Council of Provinces regarding the prosecution of water resource polluters.

• During the 2009-10 financial year, the Department of Water and Environmental Affairs did not successfully prosecute any individuals, companies, or municipalities for water resource pollution caused by commercial activities or sewerage overflow.
• The department attributes the lack of successful prosecutions to the technical complexity of the cases, which requires significant time for the South African Police Service (SAPS) to investigate and create charge sheets before the National Prosecution Authority (NPA) considers them for prosecution.
• Of the nine criminal cases reported in the 2009-10 Annual Report, one involves a mine and eight involve Water Service Authorities. The status of these cases includes seven under investigation by the SAPS, one with the NPA, and one in a Regional Magistrate Court.
