This document is a draft reply from the South African Minister of Water and Environmental Affairs to a National Assembly question regarding challenges with water source protection policy compliance, the department's mitigation plans, the impacts of non-compliance, and enforcement measures.

• The Department of Water and Environmental Affairs identifies several primary challenges regarding compliance with water source protection, including illegal water use, failure to meet effluent discharge requirements specified in license conditions, the absence of appropriate meters, and inconsistent recording of water use.
• To address compliance challenges, the Department has established the Directorate: Compliance, Monitoring and Enforcement (D: CME) and is focusing on personnel training, stakeholder engagement, and capacity building to encourage self-regulation. Additionally, the Department conducts workshops with municipalities to provide support, particularly regarding the incentive-based regulation process for Green Drop certification.
• The Department is reviewing regulatory tools to ensure suitability, which includes revising current effluent standards, developing wastewater management guidelines for various industries, and determining charge rates for the Waste Discharge System.
• Non-compliance with water source protection policies negatively impacts industrial and municipal operations. For industry, deterioration of water quality can harm produce and financial viability, affecting the broader economy. For municipalities, it reduces the quality of raw water, which directly increases water treatment costs.
• Enforcement against landowners and businesses failing to comply with the National Water Act (Act 36 of 1998) or specified authorizations involves the issuance of Directives. If these are ignored, the Department may lay criminal charges against transgressors.
