The Minister of Water and Environmental Affairs explains that the National Environmental Management: Air Quality Act, 2004 (AQA) partially commenced in 2005, with full implementation targeted for 2009/2010. • The National Environmental Management: Air Quality Act, 2004 (AQA) partially took effect on 11 September 2005, but excluded several sections, primarily those concerning the Atmospheric Emission Licensing regime to be managed by District and Metropolitan Municipalities. The 2007 National Framework for Air Quality Management in the Republic of South Africa set a timeframe of 2009/2010 for the AQA to fully enter into effect and for the subsequent repeal of the Atmospheric Pollution Prevention Act (APPA) of 1965.
• The full implementation of the AQA was delayed because the Minister required assurance that local government possessed the necessary specialist air quality management capacity. Additionally, the implementation of the new licensing regime required the identification of a new list of activities needing an Atmospheric Emission Licence and the establishment of minimum emission standards for those activities.
• The organisers of the FIFA World Cup did not establish any minimum air quality conditions for the areas in and around stadiums.
