SALE OF ANGLO AMERICANS ESKOM MINES TO SERITI RESOURCES

The Centre for Environmental Rights (CER) has called on Anglo American to act transparently in the sale of three operational and four closed coal mines to Seriti Resources. The CER argues that the trend of large mining companies selling assets with significant environmental liabilities to smaller companies often leads to a failure to comply with rehabilitation obligations. The CER requests that Anglo American publicly disclose mining licences, environmental management programmes, social and labour plans, and assessments of environmental liability and financial provision for rehabilitation to ensure these obligations are not ultimately shifted to the South African state and public.

• The CER identifies a risk where large mining companies sell mines with significant environmental liabilities to smaller companies that may be "unable, or unwilling, to comply with the rehabilitation obligations attached to the mining rights".
• Anglo American is selling seven coal mines to Seriti Resources, consisting of three operational mines and four "closed" mines.
• The CER asserts that transparency in the sale process is necessary to prevent environmental liabilities from being abandoned and becoming the responsibility of the state and the South African public.
• The CER argues that transparency in these transfers is a legal requirement under the Promotion of Administrative Justice Act, 2000.
