The South African Human Rights Commission (SAHRC) invited the Centre for Environmental Rights to contribute to a National Hearing on the socio-economic challenges of mining-affected communities in South Africa. Following consultations in KwaZulu-Natal, Limpopo, and Mpumalanga, the SAHRC identified systemic issues including regulatory non-compliance, poor enforcement, and limited community consultation. The Commission requested specific expertise on environmental monitoring, the efficacy of Environmental Impact Assessments (EIAs), and the impact of mining on water and ecosystems.

• The South African Human Rights Commission (SAHRC) identified several challenges facing mining-affected communities following consultations in KwaZulu-Natal, Limpopo, and Mpumalanga. These include non-compliance with legal frameworks and corporate social and environmental obligations by rights holders, failures in enforcement and monitoring, lack of transparency and insufficient consultation, limited collaboration between mining companies and local authorities/communities, social division within communities, and limited social upliftment.
• The SAHRC is convening a National Hearing to investigate socio-economic challenges in mining-affected communities to gather information and develop practical, time-bound recommendations for sustainable solutions. The Commission specifically requested the Centre for Environmental Rights to provide submissions on South Africa's environmental compliance monitoring and enforcement system, including the efficacy of EIAs and EMPs, their integration into Social and Labour Plans and Integrated Development Plans, the impact of mining on ecosystems and water resources, and the sustainability of mining activities.
